Brokerage Relationship Disclosure
In accordance with Colorado Revised Statutes § 12-10-408 and Colorado Real Estate Commission Rule 6.5, Corken + Company Real Estate Group provides notice that, for properties it manages or leases on behalf of property owners under an agency agreement, its designated brokers represent the property owner as the landlord's agents and do not represent prospective tenants as tenants' agents.
As the landlord's representative, the designated broker may market the property, coordinate showings, facilitate rental applications, communicate lease terms, negotiate on behalf of the landlord, and assist with lease preparation and execution. Prospective tenants are encouraged to review the Colorado Real Estate Commission's Brokerage Disclosure to Tenant, which explains the different brokerage relationships available under Colorado law.

Applicant has the right to provide Corken + Company Real Estate Group with a Portable Tenant Screening Report (PTSR) that is not more than 30 days old, as defined in § 38-12-902(2.5), Colorado Revised Statutes; and 2) if Applicant provides Corken + Company Real Estate Group with a PTSR, Corken + Company Real Estate Group is prohibited from: a) charging Applicant a rental application fee; or b) charging Applicant a fee for Corken + Company Real Estate Group to access or use the PTSR.
If Applicant provides Corken + Company Real Estate Group with a PTSR: a) the PTSR must be available to Corken + Company Real Estate Group by a consumer reporting agency/third-party website that regularly engages in the business of providing consumer reports; 2) the PTSR must comply with all state and federal laws pertaining to use and disclosure of information contained in a consumer report by a consumer reporting agency; and c) Applicant certifies that there has not been a material change in the information in the PTSR, including the Applicant's name, address, bankruptcy status, criminal history, or eviction history, since the PTSR was generated.
Every tenant is entitled to safe and healthy housing under Colorado’s warranty of habitability. A landlord is prohibited by law from retaliating against a tenant in any manner for reporting unsafe conditions in the tenant’s residential premises, requesting repairs, or seeking to enjoy the tenant’s right to safe and healthy housing.
